Terms and Conditions

These Terms and Conditions apply to the use of MELA Apps Marketplace ("MELA", "we", "us" or "our"), a Malta-based digital marketplace that connects customers with independent vendors, stores, restaurants, service providers and delivery partners. By using the website, app, admin/vendor tools or related services, you agree to these Terms.

1. Marketplace structure

MELA provides the digital platform, ordering flow, marketplace tools, customer support channels and payment or delivery coordination where available. Unless MELA is clearly identified as the seller, the products and services listed on the platform are supplied by independent vendors. Delivery may be performed by independent delivery partners, vendor staff or third-party couriers.

Depending on the order, separate relationships may exist between: (a) the customer and the vendor for the sale of goods or services; (b) the customer and the delivery partner or delivery provider for delivery; and (c) the user and MELA for use of the platform. MELA may facilitate these relationships but does not become the seller of vendor products unless expressly stated.

2. Definitions

  • Customer means a person who browses, orders, purchases or receives goods or services through MELA.
  • Vendor means an independent merchant, store, restaurant, service provider or business using MELA to offer goods or services.
  • Delivery Partner means a person or company that delivers orders, whether engaged by MELA, a vendor or a third party.
  • Order means a customer request submitted through the platform and accepted by the relevant vendor or system flow.
  • Fees may include product prices, delivery fees, service fees, small order fees, priority fees, tips and other charges shown before checkout.

3. Accounts and eligibility

  • You must provide accurate account, contact, delivery, billing and payment information.
  • You are responsible for keeping your login credentials secure and for activity carried out through your account.
  • You must be legally allowed to buy the ordered goods or services. Age-restricted goods may require age verification on delivery or collection.
  • MELA may refuse, suspend or restrict accounts, vendors, listings or orders to protect users, prevent fraud, enforce these Terms or comply with law.

4. Vendor listings, prices and ranking

Vendors are responsible for the accuracy of product names, descriptions, ingredients, allergens, images, prices, taxes, availability, business information, invoices where applicable and legal compliance. Images may be illustrative. Prices and availability can change before order acceptance.

Search, category display, recommendations and ranking may depend on factors such as location, opening hours, availability, delivery zone, customer preferences, relevance, popularity, ratings, operational performance, sponsored placement, subscription or commission arrangements and technical settings.

5. Food, allergens and regulated goods

Where food, groceries, supplements, cosmetics or other regulated goods are offered, the vendor remains responsible for legally required product information, ingredients, allergens, warnings and suitability. Customers with allergies, intolerances or specific dietary needs should check the listing and contact the vendor before ordering. MELA cannot guarantee that vendor premises or products are free from cross-contamination.

Alcohol, tobacco, medicines, age-restricted items, dangerous goods and other restricted products may be limited, refused or subject to verification. Delivery partners may refuse delivery if verification fails or delivery would be unlawful or unsafe.

6. Orders, substitutions and weighted items

An order is submitted when you complete checkout, but it is confirmed only when accepted by the vendor or platform flow. If an item is unavailable, incorrectly priced or cannot be supplied, the vendor or MELA may reject the item, suggest a substitution, adjust the order with your consent or refund the affected amount.

For groceries, fresh goods or items sold by weight, the final weight, price or packaging may differ slightly from the estimate shown at checkout. Any material adjustment should be reflected in the final charge, refund, credit or vendor communication.

7. Payments, fees, tips and credits

Prices are displayed in euro. Applicable taxes, delivery charges, service fees and other charges are shown before checkout where they apply. Payments may be processed by MELA or external payment providers. Tips, if offered, are voluntary unless clearly stated otherwise.

MELA may offer vouchers, promo codes, wallet credits or goodwill credits. These may be subject to expiry dates, usage limits, order minimums, vendor restrictions and anti-abuse rules. Unless required by law, credits are not exchangeable for cash.

8. Delivery, collection and failed delivery

Delivery times are estimates unless expressly guaranteed. Weather, traffic, vendor workload, stock issues, courier availability, address problems and force majeure may affect timing. You must provide accurate delivery details, be reachable and be available to receive the order.

If delivery fails because the address is wrong, no one answers, access is not available, verification fails, or the order is refused without valid reason, delivery fees and vendor costs may still apply where permitted by law. Perishable or prepared goods may not be refundable after failed delivery.

9. Cancellations, returns and refunds

Cancellation, return and refund rights depend on the order type, vendor acceptance, preparation stage, delivery status and applicable consumer law. Eligible consumers buying at a distance may have a statutory withdrawal right, generally within 14 days from delivery for goods, subject to legal exceptions such as perishable goods, sealed hygiene items once opened, personalised goods, time-specific services, digital content started with consent and goods unsuitable for return for health or safety reasons.

10. Vendor obligations

Vendors must keep listings accurate, supply only lawful goods and services, respect consumer rights, provide trader and tax information required by law, honour accepted orders, handle complaints fairly, comply with food safety and product safety rules, maintain required licences and use the platform honestly.

11. User content, reviews and illegal content reports

Users must not submit unlawful, misleading, abusive, discriminatory, infringing, fake or unsafe content. MELA may moderate, restrict or remove content, listings or accounts where needed for safety, legal compliance, platform integrity or these Terms.

Reports about illegal content, unsafe products, counterfeit goods, misleading vendor information or rights infringements can be sent to info@melaapps.com. Please include order number, listing link, screenshots and a clear explanation. MELA may review the report, request more information, restrict the content and, where required, notify competent authorities.

12. Intellectual property

The MELA platform, software, design, text, logos and brand assets are protected. Vendors retain rights in their lawful brand materials but grant MELA the limited rights needed to display listings, process orders, provide support and promote marketplace services.

13. Platform changes and availability

We aim to keep MELA available and accurate, but uninterrupted access is not guaranteed. We may update features, fees, vendor tools, policies or these Terms for operational, legal, security or business reasons. The latest version applies from publication unless a different effective date is stated.

14. Liability

MELA operates the platform with reasonable care. Independent vendors remain responsible for the goods or services they sell, and delivery providers remain responsible for delivery services they perform. To the maximum extent permitted by law, MELA is not liable for indirect losses, loss of profit, vendor stock issues, third-party delays or matters outside our reasonable control. This does not exclude liability that cannot be excluded under Maltese law.

15. Governing law and complaints

These Terms are governed by the laws of Malta. The courts of Malta have jurisdiction, without prejudice to mandatory consumer rights that may apply under EU or local law. Please contact info@melaapps.com first so we can try to resolve issues quickly and fairly.
